Asbestos

Building owners in New York are responsible for having a DEP-certified asbestos investigator perform an asbestos survey to determine if asbestos-containing material (ACM) will be disturbed during the course of work on their building. If the investigator determines that the building (or portion thereof) affected by the work is free ACM, the ACM present will not be disturbed by the work, or the amount of ACM to be abated constitutes a minor project, they must complete, sign, and seal an Asbestos Assessment Report (ACP-5 Form) and submit it to DEP in accordance with 15 RCNY § 1-22(b)(1) (refer to 15 RCNY § 1-23(b)(1–3) for a list of exempt activities).

An Asbestos Containing Material (ACM) Survey consists of determining which building materials within a certain work are suspected to contain asbestos. Bulk samples are then collected and sent to the lab for processing.
Such an inspection is reccomended for construction projects of all sizes and required in New York for any filed project, while only required for complete demolitions of residential properties and renovations of commercial properties in New Jersey.

For all asbestos abatement projects in New York larger than 10 sqft. or 25 linear ft of ACM, a licensed and certified third party air monitoring company must be hired to monitor levels of asbestos particles in the air and ensur all rules and regulations are being followed. Final air clearance testing is also performed to determine that abatement cleanup was properly conducted and the work area can be released for re-occupancy.

As of July 18, 2022 per regultions outlined in P.L. 2021, c. 182, New Jersey landlords are now required to obtain Lead-Safe Certification for rental properties.
There are two different types of Lead-Safe inspections: visual inspection only, or visual inspection plus dust wipe sampling. The type of inspection required depends on the municipality the property is located in.
A Lead-Safe Certificate is valid for two years from the date of issuance.

Dwellings that have been certified to be free of lead-based paint are exempt from the Lead-Safe Certification requirement.
This inspection consists of surface-by-surface testing of ALL painted surfaces both inside and outside.
A Lead-Free certificate is valid for the lifetime of the property.

A Lead Risk Assessment is recommended for families with children under 6 years old residing in or about to move into an older home or a household in which a child has elevated blood levels.

Such testing methods may include: XRF Analyzer, Dust Wipe Sampling, Visual Inspection, Water Sampling, Soil Collection, etc.

After a lead abatement project is completed it is required to conduct a lead dust wipe clearance test to ensure the work area is clean and can be released for re-occupancy.
Mold

The point of a mold assessment is to determine whether mold growth is present and root cause(s). If mold is identified durin the inspection, the report will include a recommended remediation plan.

Air testing for mold is recommended for cases in which no visible mold is observed, but is still suspected to be present.
Sample(s) of the air are collected and sent to a lab for testing of mold spore presence.
Note: Mold exists outside all around us. We must always compare mold spore levels inside the dwelling to outside the dwelling to determine that mold spores are in fact originating from within a dwelling. A rule of thumb is for raw mold spore levels indoors to be at least 10x than those of raw mold spore levels recorded outdoors.

A swab or tape sampling is recommended when potential mold growth has been visually observed. Sample(s) collected are then sent to the lab for testing to verify whether it is in fact mold, and if so what kind.
